On July 23, 2019, the Consumer Product Safety Commission (CPSC) staff published a Direct Final Rule within the Federal Register for a revision to 16 CFR 1219, Safety Standard for Full-Size Baby Cribs. 16 CFR 1219 will now reference ASTM F1169-19 Standard Consumer Safety Specification for Full-Size Baby Cribs as mandatory with no modifications.

Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. The Commission is issuing this Direct Final Rule for Full-Size Baby Cribs in response to the direction under Section 104(b) of the CPSIA.
Background of 16 CFR 1219
The Commission issued a Final Rule for 16 CFR 1219 on December 28, 2010. The Final Rule became effective on June 28, 2011 and referenced the ASTM F1169-10 Standard Consumer Safety Specification for Full-Size Baby Cribs with two modifications.
Revisions of ASTM F1169, Standard Consumer Safety Specification for Full-Size Baby Cribs
The ASTM subcommittee balloted and approved changes to the standard for a 2011 and a 2013 version. The 2011 version of the F1169 contained revisions to harmonize with the final rules released in 2010. The 2013 version contained two test clarifications that were considered acceptable by the CPSC for a revised reference to 16 CFR 1219. The 2019 version of the ASTM F1169 only contains editorial changes and clarifications.
Additional Information
The CPSC is issuing this Direct Final Rule and this will become effective on October 28, 2019 unless the CPSC receives significant adverse comments by August 22, 2019.
